Form of the Complaint
Complaints to the Ombudsperson for Child's Rights are usually submitted in written form: by post, fax or by bringing it to the Office of the Ombudsperson for Child's Rights.
A person who considers that the rights and legitimate interests of the child have been violated or that the provisions of national and international legislation governing the protection of the rights of the child have not been complied with, may apply to the Ombudsperson for Child's Rights orally. Upon receipt of an oral complaint or observation of signs of violation of the rights or legitimate interests of a child, the Ombudsperson for Child's Rights may begin the investigation, on its own initiative, considering that the information provided or the signs observed are correct.
Content of the complaint
The complaint will normally state:
- Addressee - the Ombudsperson for Child's Rights;
- Applicant's name, surname or institution name, address, telephone number;
- Names of the appealed legal entities or names, surnames, positions of the appealed individuals and institution where they work;
- The name and date of the appealed decision or a description of the actions (omissions), the time and circumstances in which they were taken;
- Request to the Ombudsperson for Child's Rights; List of attached documents;
- Complaint registration date and signature of the applicant.
The submitter of the electronic complaint (request) will be notified within 3 working days whether it is to be examined at the Office of the Ombudsperson for Child's Rights, and if it is necessary to supplement its content, we will provide information (consultation). However, in all cases, the complaint (request) will only be processed upon receipt of the original. The day of filing a complaint (request) will be considered the day when the signed original of the complaint (request) is received at the institution.
The following may be attached to the complaint:
- a copy of the judgment under appeal; available evidence or their description;
- a list of the individuals proposed to be interviewed, giving their addresses and the circumstances or information they may confirm.
The requirements specified in the written application do not apply when a child appeals to the Ombudsperson for Child's Rights. |
